❌ Abuse & Exploitation

• Rate Limit Circumvention: Attempting to bypass, disable, or circumvent API rate limits or usage restrictions.
• Automated Abuse: Using bots, scrapers, crawlers, or automated scripts to excessively access the Service.
• DDoS Attacks: Launching denial-of-service attacks or intentionally overwhelming our servers.
• Exploiting Vulnerabilities: Attempting to hack, breach security, or exploit technical vulnerabilities in the Service.
• Reverse Engineering: Decompiling, disassembling, or reverse engineering our software or algorithms.

❌ Misrepresentation

• False Affiliation: Claiming partnership, endorsement, or affiliation with Flip A Coin Free without authorization.

❌ Harmful Content

• Illegal Content: Using the Service in connection with illegal, harmful, or offensive content.
• Harassment: Using the Service to harass, bully, threaten, or harm individuals or groups.

7. API Terms & Conditions

If you access our API, the following additional terms apply in addition to the general Terms of Service:

API Access & Authentication

• API access may require registration and issuance of an API key for tracking and rate limiting purposes.
• You are responsible for maintaining the confidentiality of your API key and all activities under your key.
• You must immediately notify us if you suspect unauthorized use of your API key.

Rate Limits & Fair Usage

• Rate limits are enforced per API key per 24-hour period (UTC timezone).
• Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses.
• Abusive or excessive usage may result in permanent API suspension without notice.
• Commercial applications with high traffic should contact us for commercial licensing options.

API Response & Reliability

• We aim for 99.9% API uptime but do not guarantee availability.
• API responses are provided "as is" without warranties of accuracy or reliability.
• We may modify, deprecate, or discontinue API endpoints with reasonable advance notice.
• Breaking changes will be communicated via email (if provided) or API documentation updates.

API Attribution Requirements

Free tier API users must provide visible attribution in their application or website, such as:

Commercial tier users may negotiate attribution waiver as part of licensing agreement.

8. Embed Widget Terms

Our embed widget allows you to integrate Flip A Coin Free functionality directly into your website. The following terms apply:

Widget Usage Rights

• The embed widget is free to use on personal, educational, and commercial websites.
• You may customize the widget's appearance (size, positioning) but NOT modify the widget code itself.
• You must NOT remove attribution links or branding from the widget.
• The widget must be embedded using our official embed code - hosting modified versions is prohibited.

Website Requirements

• Websites embedding the widget must comply with all applicable laws and regulations.
• Websites must NOT contain illegal, harmful, discriminatory, or offensive content.
• Websites must NOT use the widget for gambling with real money or critical decision-making.
• We reserve the right to block widget access to websites that violate these Terms or applicable laws.

Analytics & Data Collection

Widget Availability & Updates

Effect of Termination

• API keys will be revoked and no longer functional
• Embed widgets may cease to function on your website
• Any data associated with your account may be deleted
• Provisions that by their nature should survive termination will remain in effect (e.g., limitations of liability, indemnification)

Appeal Process

If you believe your account was terminated in error, you may contact us at legal@flipacoinfree.com to request a review. We will investigate in good faith but are not obligated to reinstate access.

18. Dispute Resolution

Informal Resolution

Before filing a formal claim, you agree to first contact us at legal@flipacoinfree.com to attempt to resolve the dispute informally. We will work in good faith to reach a mutually acceptable resolution within 60 days.

Binding Arbitration (If Applicable)

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the commercial arbitration rules of the jurisdiction where Flip A Coin Free is established. Arbitration shall be conducted by a single arbitrator agreed upon by both parties.

Arbitration Agreement:

• Arbitration will be conducted on an individual basis, not as a class action
• Each party will bear its own costs and attorney's fees unless otherwise awarded
• The arbitrator's decision will be final and binding
• Judgment on the award may be entered in any court of competent jurisdiction

Exceptions to Arbitration

Either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized use of the Service.

Class Action Waiver
